Revision Made to Implementing Rules for the Regulations of China on the Protection of New Varieties of Plants (Agriculture Part)

The Ministry of Agriculture of China promulgated the latest amendment to Implementing Rules for the Regulations on the Protection of New Varieties of Plants (Agriculture Part).

 

The implementing rules were promulgated by Order No. 5 of September, 19, 2007, of the Ministry of Agriculture and revised by Order No. 4 of the Ministry of Agriculture on December 31, 2011 for the first time.

 

This is the second time for its revision, where Article 24 is revised into: “Where any Chinese entity or individual intends to file an application for variety right in a foreign country in respect of a new plant variety bred in China, it or he shall file an application for registration with the provincial people's government administrative departments of agriculture.”

 

The previous revision wrote that the application shall be filed with the Ministry of Agriculture.

 

This amendment takes effect as of April 25, 2014.
