Beijing High Court Issued Guidelines for Trial of Administrative Cases Involving Trademark

Recently, the Beijing High Court issued the Guidelines for Trial of Administrative Cases Involving Granting and Ownership Determination of Trademark Rights. 

The Guidance refers mainly to the recognition and protection of well-known trademarks, the recognition and protection geographical indications, (3) the determination on confusion between trademarks, (4) the protection of prior rights and procedural matters.

The Guidelines is effective for trademark cases before the Beijing High People’s Court, the Beijing Intermediate People’s Courts, and some primary people’s courts. It may also provide reference for the operation in other regions of China.
